Sales terms (CGV)
[FILL IN] item and confirm the policies against your actual business and hosting setup. These pages are working drafts, not legal advice.Draft prepared 17 October 2026 · English version
These draft terms cover purchases of Quads from idrawq by consumers. User-to-user art listings are separate transactions: buyers pay the seller in Quads, not money.
1. Seller and contact
Seller/operator: Frédéric Verlain, an individual based in France. Customer service: fredericverlain3@gmail.com. Public postal address: [FILL IN]. [FILL IN: confirm whether selling Quads is a professional/commercial activity and provide any required registration and tax details before launch].
2. What is sold
Quads are digital platform credits added to a user account after confirmed payment. Current packages in the code are 100, 500 and 1,000 Quads, subject to availability. Quads are for use in idrawq features, including purchasing eligible drawings from other users. They cannot be withdrawn or converted to cash in the app. Unused Quads do not expire while the account remains open, but any remaining balance is deleted when the account is closed and is not refunded, subject to any mandatory rights that apply.
3. Price, taxes and payment
The package, total price, currency and any applicable taxes must be displayed clearly before the customer places an order. The checkout page is the final offer. Payment is processed by Stripe; idrawq credits the Quads after Stripe confirms successful payment. [FILL IN: legal seller’s tax treatment, invoice/receipt process, supported countries/currencies and any fees]. Do not put live prices in these terms that differ from checkout.
4. Order and delivery
Before confirming an order, the customer should be able to review the package, total price, these terms and any applicable withdrawal information. An order is accepted when payment is confirmed. Quads are delivered by crediting the account balance. If payment is taken but the balance is not credited, contact fredericverlain3@gmail.com with the account name and payment reference; do not send full card details.
5. Withdrawal and digital content
Proposed policy, not yet active: for a change of mind, you want Quads purchases to be final once the Quads have been delivered immediately. French law allows an exception to the 14-day withdrawal right for certain paid digital content only when the customer first expressly agrees to immediate performance, acknowledges the loss of the withdrawal right, and receives confirmation of that agreement on a durable medium. [FILL IN: confirm that Quads qualify and have a French/EU adviser approve this policy]. The current idrawq checkout does not collect or record that separate express consent and acknowledgment, nor does this app send a confirmation of it. Until those steps are implemented and confirmed, this proposed no-refund rule must not be relied on.
If a technical problem prevents paid Quads from being delivered, contact fredericverlain3@gmail.com; the seller will investigate and provide the remedy required by law, which may include delivery or a refund. Unauthorized payment claims, including a minor’s purchase without the required authorization, will be investigated and handled under applicable law and payment rules. Nothing in this policy removes mandatory consumer rights.
Withdrawal contact and procedure: fredericverlain3@gmail.com; postal address and any required model form/procedure: [FILL IN after review]. The current app does not provide an online withdrawal control.
6. Problems, refunds and complaints
For a payment or delivery problem, contact fredericverlain3@gmail.com. Postal contact: [FILL IN]. [FILL IN: complaint handling steps, response timeframe and any required consumer mediator details]. Applicable statutory conformity, refund and other consumer remedies remain available.
7. User-to-user listings
Only users with an email address in valid format may sell; the app checks that one is present but does not verify that the seller controls the mailbox. The buyer transfers Quads to the seller’s account; idrawq does not pay sellers real money.
Intended buyer rights, subject to a legally valid written transfer: the buyer is intended to receive ownership of the drawing and the transferable economic rights needed to use it commercially, edit or remix it, reproduce it, and redistribute or resell it on idrawq. The buyer may not claim to have created the original work. The original creator remains credited, including as “Deleted_User” if they delete their account. The creator’s moral rights, including the right to be identified as author and to have the work respected, remain with the creator under French law.
[LEGAL REVIEW REQUIRED] French law requires a copyright transfer to identify each transferred right separately and define its scope, purpose, territory and duration; contracts transferring copyright must be recorded in writing. The present marketplace flow only transfers Quads and records ownership; it does not capture a separate buyer/seller copyright assignment, and editing/remixing is not currently available in the app. Do not treat the intended transfer above as an effective copyright assignment until the exact written terms and transaction acceptance flow are implemented and reviewed. A creator’s changed username currently changes the displayed attribution. Also define what happens to a buyer’s rights if a drawing is removed for a rule or legal violation.
8. Governing law
France. Mandatory consumer protections in the customer’s country of residence continue to apply. Confirm the final wording with a qualified adviser.
